Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of the Vially mobile application ("the App") and the Vially website at vially.app ("the Website"). By downloading, installing, or using Vially, you agree to these Terms. If you do not agree, please do not use the App.

Vially is a freemium application — core features are free, and optional premium features are available through a paid subscription (Vially Pro).

Disclaimer: Not a Medical Device

Vially is not a medical device and does not provide medical advice. The App is a personal health tracking tool designed to help you log and organize your medication data. It is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Information provided by the App — including AI-powered lab result scanning, peptide calculations, health risk scores, and progress tracking — is for informational and personal tracking purposes only. Always consult your healthcare provider before:

  • Starting, stopping, or changing any medication
  • Making decisions based on lab results or health data
  • Adjusting your medication dosage or schedule
  • Interpreting any health information shown in the App

Do not rely on the App as a substitute for professional medical advice, diagnosis, or treatment. In the event of a medical emergency, contact your local emergency services immediately.

Third-Party Services

Vially integrates with the following third-party services, each governed by their own terms:

  • RevenueCat — Subscription and in-app purchase management
  • Google Gemini API — AI-powered lab result scanning (Vially Pro)
  • Apple App Store — App distribution and payment processing

We are not responsible for the practices or policies of these third-party services.

User Responsibilities

By using Vially, you agree to the following:

  • Age requirement: You must be at least 17 years old to use the App.
  • Device security: You are responsible for maintaining the security of your device, including passcodes and biometric locks. Since all health data is stored locally, anyone with access to your unlocked device may be able to view your data.
  • Data backup: You are solely responsible for backing up your data. Vially stores data on your device, and deleting the App removes all data permanently.
  • Accurate information: Any data you enter into the App is your responsibility. Do not rely on the App for medical-grade accuracy.
  • Connectivity: Certain features (AI lab scanning, subscription verification) require an internet connection. You are responsible for your own connectivity.
  • Lawful use: You agree to use the App only for lawful purposes and in accordance with these Terms.

Subscriptions & Payments

Vially offers an optional paid subscription ("Vially Pro") with additional features. All subscriptions are managed through the Apple App Store.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.
  • Refunds are handled by Apple according to their refund policy.
  • We reserve the right to change subscription pricing. Any price changes will apply to the next billing cycle after notice.

Free features remain free and are not affected by subscription status.

Accuracy of Information

While we strive for accuracy, Vially does not guarantee that any information provided by the App is accurate, complete, or current. This includes but is not limited to:

  • AI-powered lab scanning results and biomarker extraction
  • Peptide reconstitution calculations and syringe unit conversions
  • Health risk scores and domain assessments
  • Medication information and scheduling suggestions
  • Progress tracking and trend analysis

You should independently verify all information with your healthcare provider.

Intellectual Property

The App, including its design, source code, content, branding, and all associated materials, is owned by Vially and protected by copyright and intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse-engineer, decompile, or disassemble the App
  • Use the Vially name, logo, or branding without written permission
  • Create derivative works based on the App

Limitation of Liability

To the maximum extent permitted by applicable law, Vially and its developers, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes but is not limited to:

  • Loss of data stored on your device
  • Health outcomes resulting from use of or reliance on the App
  • Inaccuracies in lab scanning, calculations, or tracking features
  • Missed medication reminders or notifications
  • Damages arising from unauthorized access to your device
  • Service interruptions or feature unavailability

In no event shall our total liability exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

Class Action Waiver

You agree that any dispute arising from or relating to these Terms or the App shall be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against Vially.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States. You and Vially each waive the right to a jury trial.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you acknowledge that all health data is stored locally on your device and that you are responsible for your data security and backup.

Termination

We reserve the right to terminate or restrict access to the App at any time, with or without cause. You may stop using the App at any time by deleting it from your device. Upon termination, all locally stored data will remain on your device until you delete the App.

Indemnification

You agree to indemnify and hold harmless Vially, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of the App after changes constitutes acceptance of the updated Terms. Since we don't collect email addresses, we encourage you to review these Terms periodically.
